Article 40

The implementation of the common foreign and security policy shall not affect the application of the procedures and the extent of the powers of the institutions laid down by the Treaties for the exercise of the Union competences referred to in Articles 3 to 6 of the Treaty on the Functioning of the European Union.

Similarly, the implementation of the policies listed in those Articles shall not affect the application of the procedures and the extent of the powers of the institutions laid down by the Treaties for the exercise of the Union competences under this Chapter.

Background

  • This article clarifies that the implementation of the Common Foreign and Security Policy (CFSP) should not be done at the expense of policies listed in various other articles.
  • It also specifies that the CFSP should not undermine shared competences listed in Article 4 (which includes development cooperation and humanitarian aid).

Comments

  • This article is absolutely crucial as it reaffirms development cooperation and humanitarian aid as policies in their own right which should not be dominated by the CFSP.
